Chicago Primal, LLC d/b/a Kettlebell Transformation ("Chicago Primal," "Kettlebell Transformation," "we," "us," or "our") respects your privacy. This Privacy Policy explains what information we collect, how we use and share it, and the choices you have.
This Policy applies to kettlebelltransformation.co and any other website, application, or online resource that links to it, and to our coaching programs, digital products, and related services (together, the "Services").
By using the Services, you agree to this Privacy Policy and to our Terms and Conditions.
1. Information We Collect
1.1 Information you give us
Contact and account information. Name, email address, phone number, mailing address, username and password, and similar identifiers.
Order and payment information. Billing address, purchase history, transaction records, and partial payment card details. Payments are processed by third-party processors. We do not store full payment card numbers on our servers.
Health, fitness, and progress information. Body weight, measurements, body composition and body fat estimates, progress photographs, training history, movement video you submit for coaching, goals and preferences, schedule, nutrition habits and food logs, and health information you choose to share with us so that we can coach you safely — for example injuries, physical limitations, and relevant medical history.
Communications and content. Messages, check-ins, forms, surveys, support requests, reviews, testimonials, and anything else you send us through our coaching platform, email, text, or other channels.
1.2 Information we collect automatically
When you use the Services we may automatically collect usage and device data, including IP address, browser and device type, device identifiers, operating system, referring page, pages viewed, time spent, and similar technical information, using cookies and comparable technologies.
1.3 Information from third parties
We receive information from vendors and service providers who support the Services, including our CRM and messaging platform, our payment processor, our scheduling tools, our coaching platform, our analytics providers, and our advertising partners. Any information we receive is handled under this Policy.
2. How We Use Your Information
We use your information to:
Provide, operate, and improve the Services
Design, deliver, and adjust your training, nutrition, and coaching plan
Communicate with you about your account, orders, program, scheduling, and support
Process payments, subscriptions, and account administration
Ship physical products and handle related logistics
Send educational content, offers, and marketing communications, subject to Section 6
Analyze and improve our websites, content, advertising, and customer experience
Detect, investigate, and prevent fraud, abuse, and security incidents
Comply with legal obligations and enforce our Terms and policies
We may de-identify or aggregate information so that it no longer reasonably identifies you, and may use and share that data for research, analytics, and business purposes.
3. Health and Progress Information
We understand that your health information, check-ins, body measurements, and progress photographs are personal. We treat them accordingly.
We do not publish your progress photographs, body statistics, movement video, or private check-in information without your permission. If we want to use a testimonial, screenshot, or before-and-after image in marketing, we obtain your consent first through a signed release or documented written authorization.
You may withdraw consent for future use at any time by contacting us. Withdrawal does not affect use that has already occurred but stops further use.
Access to your health and progress information is limited to team members and contractors who need it to deliver or support your program and who are bound by confidentiality obligations.
We do not sell your health information, and we do not share it with advertisers or data brokers.
Kettlebell Transformation is not a healthcare provider and is not a covered entity under HIPAA. The information you share with us is not protected health information under that statute. It is protected under this Policy and under applicable state consumer health privacy laws.
Washington, Nevada, and Connecticut residents. Certain state laws — including the Washington My Health My Data Act — treat information about your physical condition, body measurements, and fitness activity as regulated consumer health data. If you are a resident of one of those states, you have additional rights, including the right to confirm whether we collect your consumer health data, the right to have it deleted, and the right to withdraw consent to its collection or sharing. We will not share your consumer health data with a third party without obtaining a separate, valid authorization from you. To exercise these rights, email [email protected].
4. How We Share Your Information
We do not sell your personal information. We do not rent, lease, or transfer your contact details or consent status to any third party for that party's own marketing purposes.
We share information with:
Service providers and contractors who perform services on our behalf — payment processors, email and SMS platforms, CRM and hosting providers, scheduling tools, analytics providers, coaching platforms, and shipping partners. They are authorized to use your information only to provide those services to us.
Coaches and team members who need access to deliver and support your program.
Advertising and analytics partners, as described in Section 5, in connection with measuring and improving our marketing. We do not share your health or progress information with these partners.
Business transfers, if we are involved in a merger, acquisition, restructuring, financing, or sale of assets, in which case your information may transfer as part of that transaction.
Legal and safety purposes, if required by law, subpoena, or court order, or where we believe disclosure is necessary to protect our rights, your safety, or the safety of others, or to investigate fraud or a security issue.
If you interact with third-party websites, apps, or ads linked from our properties, their privacy policies govern, not this one.
5. Cookies, Pixels, and Advertising
We use cookies, pixels, tags, and similar technologies to remember your preferences and login session, understand how visitors use our sites, improve performance, and deliver and measure advertising.
Third parties — including analytics and advertising partners — may set their own cookies or similar technologies on our sites. Their use of that information is governed by their own privacy policies.
You can usually configure your browser to refuse cookies or to alert you when cookies are sent. Disabling cookies may cause some features of the Services not to work. Many advertising partners also offer their own opt-out controls, and industry opt-out tools are available through the Digital Advertising Alliance and the Network Advertising Initiative.
Some browsers send a Global Privacy Control or similar opt-out preference signal. Where required by law, we treat that signal as a request to opt out of the sharing of personal information for targeted advertising.
6. Email, Calls, and Text Messages
6.1 Service and transactional messages
When you purchase from us or submit a request, we use the contact information you provide to deliver what you asked for — order confirmations, account and program information, scheduling, and support.
6.2 Marketing messages
We send marketing calls and text messages only to people who have given prior express written consent. Consent to receive marketing calls or texts is never a condition of purchasing anything from us. Where we have consent, calls and messages may be automated, may use an automatic telephone dialing system, and may use a prerecorded or artificial voice, including an AI-generated voice.
6.3 SMS program terms
Program name: Kettlebell Transformation. Message frequency varies. Message and data rates may apply. Reply HELP for help or STOP to opt out. Carriers are not liable for delayed or undelivered messages.
6.4 SMS consent is never shared
We will not share your opt-in to an SMS campaign with any third party for purposes unrelated to that campaign. We may share your consent status with vendors who help us deliver messages, including platform providers and phone carriers. All categories of information sharing described in this Policy exclude text messaging originator opt-in data and consent; that information is not shared with any third party.
6.5 Opting out
You may withdraw consent and ask us to stop contacting you at any time, by any reasonable method — reply STOP to any text, use the unsubscribe link in any email, tell a representative during a call, or email [email protected]. See our Do-Not-Call Policy for full details. If you opt out of marketing, we may still send messages necessary to deliver a product or service you purchased.
7. Your Rights and Choices
Depending on where you live, you may have some or all of the following rights:
Access and portability. Request a copy of the personal information we hold about you and information about how we use and share it.
Correction. Request that we correct inaccurate information.
Deletion. Request that we delete personal information, subject to legal and legitimate business exceptions such as
transaction records and records we must retain to defend legal claims.
Opt out of targeted advertising and of the sharing of personal information for that purpose.
Withdraw consent, including consent to marketing calls and texts and consent to the use of your testimonials, photographs, or video.
Non-discrimination. We will not discriminate against you for exercising any of these rights.
Appeal. If we decline a request, you may appeal by replying to our response.
To exercise any right, email [email protected] or write to the address in Section 13. We may need to verify your identity before responding, and we will respond within the time required by applicable law. You may use an authorized agent where the law permits, and we may require proof of authorization.
8. Data Retention
We retain personal information for as long as we need it to provide the Services, maintain your account, comply with legal obligations, resolve disputes, and enforce our agreements.
Coaching, health, and progress records: retained for the duration of your program and for a reasonable period afterward.
Transaction and tax records: retained as required by law.
Consent and opt-out records: retained for at least five (5) years, and opt-out records indefinitely so that we do not contact you again in error.
When we no longer need information, we delete it or de-identify it.
9. Data Security
We use reasonable technical and organizational safeguards to protect personal information against loss, misuse, and unauthorized access, disclosure, alteration, and destruction. No method of transmission or storage is completely secure, and we cannot guarantee absolute security. Use strong, unique credentials and do not send sensitive information through insecure channels.
10. Children's Privacy
The Services are intended for adults and are not directed to children under 13. We do not knowingly collect personal information from children under 13. If you believe a child has provided us with personal information, contact us at [email protected] and we will delete it.
11. International Users
We are based in the United States. If you access the Services from outside the United States, your information may be transferred to, stored, and processed in the United States, where data protection laws may differ from those in your country. By using the Services, you consent to that transfer.
12. Changes to This Policy
We may update this Privacy Policy from time to time. When we do, we will revise the "Last updated" date. If we make material changes, we will provide additional notice, such as a banner on our website or an email. Your continued use of the Services after changes take effect means you accept the updated Policy.
